Comments: what's the deal with blocking off Vaughn Drive today? What's up. Maybe courtney is building a bridge to a hi-rise or something. BTW why in the heck is he hell-bent on * * * up the riverfront? Is it ego or money?

Comments: In additions to Mr. Auxiers point- it seems obvious that those who help pay for legal action are not necessarily those who are also named in the case. Imagine if family members who helped pay for a loved ones legal fees where then somehow legally or financially responsible for the crimes. Or if by helping a friend with attorney fees in a divorce somehow obligated one to pitch in on the settlement. In this case simply pledging dollars doesn't even mean those dollars will be needed. Most importantly those who do pay or pledge will NOT be named as plaintiffs in the law suit. Only one person -Richard Ice will have the pledge list. It is confidential.
As for the post coming out of city hall in an effort to scare donors- the ip address is not city hall but I suppose it could have been at the request of city hall.
Most importantly- its far to late to try to scare people away from donating. In fact donations were suspended in favor of pledges for possible future need simply because there is ample funding to move forward. have a great day tjh

Comments: By far the community supports responsible development in appropriate areas. Dr. Bob Candida believes that "80-90% of residents are against" the proposed riverfront development. Frankly, no one is going to find a single citizen who will stand up for irresponsible development in inappropriate areas. Go ahead and ask. But Dr. Bob is right.
Maybe there are few folks who don't think building in a flood plain is a bad idea and a few who think constructing a building higher than fire dept ladders can safely reach under certain conditions is an okay risk. There may be a few who believe destroying the heart of the community's ONLY recreation district is an investment in the future or that by building only on one side of the street, no will happen to look "over there" and notice the big giant building with HVAC stuck all on top. MAYBE. But the public outcry has overwhelmingly and publicly been against placing a multistory, market rate housing unit without adequate parking and set backs, in a flood plain while simultaneously devastating the community's (and county's) only gathering place, that can comfortably accommodate the entire population and our guests for whatever events or celebrations we may desire. Basically, there's no need to "do a study" on whether the public is for or against this anymore than I would waste money on a study to determine if the sky is blue or earth is round. Somethings are simply obvious by what is staring us in the face. The sky is blue, the earth is round and 80-90% of the people are against this development because they find it irresponsible and in the wrong location. thanks for asking. tjh

Comments: In Indiana, the American Rule mandates that each party to a legal matter must pay their own attorney fees, regardless of who wins the case. There are exceptions, however in an appeal of zoning change made by the City it is highly unlikely any of the exceptions would allow either party to recover their attorney fees, regardless of outcome.

Comments: I fully support those that want to initiate legal proceedings against the City of Madison, City Council, Plan Commission and the Mayor, and whomever else if that's what you think is best. It's your call. Spreading the legal costs and enlisting patrons to financially support said lawsuit is prudent as well. Just be aware, if you do not win, how would you split up the financial liability if you are ordered to pay the legal fees incurred of the city? I'm curious how that works and of you have even thought about that? Probably something you should run by your legal council and disclose to the public that is considering pledging. Do the pledges encompass the potential liability too?
